Google Loses the GMail Name in Europe
A little over a year ago, Google lost a battle for using it’s GMail name in the UK, and now it lost it’s right over the name in all of Europe.
The Office for Harmonisation in the Internal Market (OHIM), the body which is responsible for European community trademarks, rejected Google’s appeal after a stiff battle with German-born venture capitalist Daniel Giersch.
In it’s defence, Google claimed that the names are not confusingly similar as Giersch, who owned the trademark for over 6 years, uses it for a competition service to the Deutsche Post. They even offered him $250,000 to settle for the name, but he refused and called Google’s behaviour “very threatening, very aggressive and very unfaithful.”
So from now on, all European users will not see any reference to Gmail but only GoogleMail.
